KUISINE Privacy Policy

1. Who We Are

KUISINE operates websites, mobile applications, marketplace tools, payment, messaging, ordering, and customer support services (collectively, the "Services").

This Privacy Policy explains how we collect, use, disclose, retain, and protect personal information when you use KUISINE.

2. Personal Information We Collect

We may collect the following categories of personal information:

  • Account information: name, email address, phone number, password or login credentials, profile photo, language preferences, and account settings.
  • Order and transaction information: orders, bookings, delivery or pickup details, payment status, refunds, credits, promo codes, invoices, tax information, and transaction history.
  • Payment information: payment card or banking details are processed by our payment providers. We generally do not store full payment card numbers.
  • Marketplace/provider information: if you register as a seller, cook, vendor, creator, courier, or business partner, we may collect business name, government ID where required, licensing or permit information, tax information, payout details, insurance information, menu/listing information, and compliance documents.
  • Communications: messages sent through the platform, customer support requests, reviews, ratings, complaints, survey responses, and other communications with us or other users.
  • Device and usage information: IP address, device identifiers, browser type, operating system, app version, pages viewed, clicks, referring pages, approximate location, crash logs, and usage analytics.
  • Location information: approximate location from your IP address and, with your permission, precise device location for features such as nearby listings, delivery, pickup, fraud prevention, or safety.
  • Cookies and similar technologies: cookies, pixels, SDKs, and local storage used for login, preferences, analytics, security, advertising attribution, and product improvement.

3. How We Use Personal Information

We use personal information to:

  • create and manage accounts;
  • provide listings, ordering, booking, payment, delivery, pickup, messaging, reviews, and support;
  • process payments, payouts, refunds, credits, and taxes;
  • verify users, vendors, businesses, and eligibility;
  • prevent fraud, abuse, spam, platform misuse, and security incidents;
  • investigate disputes, complaints, policy violations, chargebacks, and safety issues;
  • personalize content, recommendations, search results, and platform experience;
  • send service messages, receipts, notices, updates, and support communications;
  • send marketing communications where permitted by law, with opt-out options;
  • conduct analytics, debugging, research, and product improvement;
  • comply with legal, tax, accounting, regulatory, and law enforcement obligations;
  • enforce our Terms of Service and other policies.

4. Consent

We collect, use, and disclose personal information with your consent, where required by law, or where otherwise permitted or required by applicable law. Your consent may be express or implied depending on the sensitivity of the information and the circumstances.

You may withdraw consent at any time, subject to legal or contractual restrictions. If you withdraw consent, some Services may no longer be available.

5. When We Share Personal Information

We may disclose personal information to:

  • users, sellers, vendors, couriers, or partners as needed to complete orders, bookings, delivery, pickup, support, reviews, or disputes;
  • payment processors, payout providers, fraud prevention vendors, hosting providers, analytics providers, email/SMS providers, customer support tools, and other service providers;
  • professional advisors, including lawyers, accountants, auditors, insurers, and financial institutions;
  • government, regulatory, tax, law enforcement, or court authorities where required or permitted by law;
  • another organization in connection with a merger, financing, acquisition, sale, restructuring, or transfer of all or part of our business;
  • other parties with your consent.
  • We require service providers to protect personal information and use it only for the services they provide to us.

6. International Transfers

Some of our service providers may process or store personal information outside your province or country, including in the United States or other jurisdictions. Information processed outside Canada may be subject to foreign laws and lawful access by foreign authorities.

7. Cookies, Analytics, and Advertising

We use cookies and similar technologies to operate the Services, keep you logged in, remember preferences, measure performance, understand usage, prevent fraud, and support marketing or advertising.

The Services are not intended for children under 13. We do not knowingly collect personal information from children under 13 without appropriate parental or guardian consent.

12. Quebec Residents

If we provide Services to Quebec residents, we will comply with applicable Quebec privacy requirements, including clear privacy disclosures, privacy-by-default settings where required, and handling confidentiality incidents according to applicable law.

13. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. If we make material changes, we will provide notice by posting the updated policy, updating the effective date, or using other reasonable methods.

KUISINE Terms of Service

These Terms of Service ("Terms") govern your access to and use of KUISINE's websites, mobile applications, marketplace, ordering, booking, payment, messaging, review, and related services (the "Services"). By using the Services, you agree to these Terms.

1. Who We Are

The Services are operated by KUISINE ("KUISINE," "we," "us," or "our").

2. Eligibility

You must be at least 13 years old to use the Services. If you are under the age of majority in your province, state, or country, you may use the Services only with the consent of a parent or legal guardian.

You represent that the information you provide is accurate, current, and complete.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must notify us promptly if you suspect unauthorized access.

We may suspend or terminate accounts that violate these Terms, create risk, engage in fraud or abuse, or harm the Services or other users.

4. Platform Role

KUISINE provides a platform that may allow users to discover, order, book, purchase, sell, provide, deliver, review, or communicate about meals, food items, services, experiences, or other offerings.

Unless expressly stated otherwise, KUISINE is not the producer, seller, employer, agent, insurer, or guarantor of third-party offerings listed on the platform. Third-party providers are responsible for their own listings, products, services, permits, taxes, safety, quality, and legal compliance.

5. Listings and Provider Responsibilities

If you list or provide goods or services through KUISINE, you are responsible for:

  • providing accurate, complete, and non-misleading listing information;
  • complying with applicable food safety, health, business, licensing, tax, employment, consumer protection, and advertising laws;
  • fulfilling accepted orders or bookings;
  • clearly disclosing allergens, ingredients, restrictions, fees, availability, cancellation rules, and other material terms;
  • maintaining required permits, insurance, and approvals;
  • handling your personnel, subcontractors, suppliers, and operations lawfully.
  • KUISINE may remove listings or suspend providers that violate these Terms or applicable law.

6. Orders, Payments, Fees, and Taxes

Prices, fees, taxes, delivery charges, service fees, and other charges will be shown before checkout where required by law.

You authorize KUISINE and its payment providers to charge your selected payment method for orders, fees, taxes, tips, subscriptions, penalties, chargebacks, or other amounts you agree to pay.

Providers are responsible for applicable taxes unless KUISINE is legally required to collect or remit them.

KUISINE may correct pricing or technical errors, but we will not charge you materially different amounts without notice where required by law.

7. Cancellations, Refunds, and Credits

Cancellation, refund, and credit rules may depend on the type of order, provider policy, timing, product category, and applicable law.

KUISINE may issue refunds or credits at its discretion or as required by law. Credits may expire, may be non-transferable, and may not be redeemable for cash unless required by law.

8. User Content

You may submit content such as profiles, photos, listings, descriptions, messages, reviews, ratings, comments, and feedback ("User Content").

You retain ownership of your User Content, but you grant KUISINE a worldwide, non-exclusive, royalty-free license to use, host, store, reproduce, modify, display, distribute, and otherwise process User Content to operate, improve, promote, and protect the Services.

You must not submit User Content that is false, misleading, defamatory, infringing, unlawful, discriminatory, harassing, unsafe, or harmful.

We may remove or restrict User Content at our discretion.

9. Reviews and Ratings

Reviews must be honest, relevant, and based on genuine experiences. You must not manipulate reviews, post fake reviews, offer compensation for positive reviews, threaten negative reviews, or review your own competing services.

10. Acceptable Use

You must not:

  • violate laws or third-party rights;
  • use the Services for fraud, abuse, harassment, spam, or deception;
  • interfere with platform security or operation;
  • scrape, copy, or harvest data without permission;
  • reverse engineer or misuse software;
  • bypass fees, payment systems, trust and safety processes, or platform rules;
  • upload malware or harmful code;
  • impersonate others or misrepresent affiliation;
  • use the Services to sell illegal, unsafe, recalled, counterfeit, or prohibited items.

11. Food, Health, and Safety Disclaimer

If KUISINE involves food, meals, kitchens, delivery, pickup, catering, or similar offerings, users and providers acknowledge that food-related services may involve risks, including allergens, contamination, mislabeling, spoilage, handling issues, and individual health sensitivities.

Providers are responsible for accurate allergen and ingredient disclosures and compliance with applicable food safety laws. Users are responsible for reviewing available information and making choices appropriate for their health needs.

KUISINE does not guarantee that any item is allergen-free, contamination-free, or suitable for a specific dietary or medical condition unless expressly stated by the verified provider.

12. Third-Party Services

The Services may contain links or integrations with third-party services, including payment processors, maps, delivery providers, analytics tools, social login, or external websites. KUISINE is not responsible for third-party services, terms, policies, or practices.

13. Intellectual Property

KUISINE and its logos, trademarks, software, designs, content, and platform materials are owned by KUISINE or its licensors. You may not copy, modify, distribute, sell, or exploit them without permission.

14. Promotions

Promotions, referral programs, discounts, credits, or coupons may be subject to additional terms. KUISINE may modify or end promotions at any time, subject to applicable law.

15. Suspension and Termination

We may suspend, restrict, or terminate your access to the Services if we believe you violated these Terms, created risk, caused harm, violated law, or engaged in fraud, abuse, or platform misuse.

You may stop using the Services at any time. Certain obligations survive termination, including payment obligations, liability limitations, dispute terms, and intellectual property provisions.

16. Disclaimers

The Services are provided "as is" and "as available." To the maximum extent permitted by law, KUISINE disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and reliability.

We do not guarantee that the Services will be uninterrupted, error-free, secure, or free from harmful components.

17. Limitation of Liability

To the maximum extent permitted by law, KUISINE and its directors, officers, employees, contractors, affiliates, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost goodwill, or business interruption.

To the maximum extent permitted by law, KUISINE's total liability for any claim will not exceed the greater of: (a) the amount you paid to KUISINE for the transaction giving rise to the claim; or (b) CAD $100.

Some jurisdictions do not allow certain exclusions or limitations, so some of the above may not apply to you.

18. Indemnity

You agree to indemnify and hold harmless KUISINE and its directors, officers, employees, contractors, affiliates, and agents from claims, losses, liabilities, damages, costs, and expenses arising from your use of the Services, User Content, listings, products or services you provide, violation of these Terms, violation of law, or infringement of third-party rights.

19. Governing Law and Disputes

These Terms are governed by the laws of British Columbia and the federal laws of Canada applicable there, without regard to conflict of law rules.

Subject to applicable consumer protection laws, the courts located in Vancouver, British Columbia will have exclusive jurisdiction over disputes arising from these Terms or the Services.

20. Changes to These Terms

We may update these Terms from time to time. If changes are material, we will provide reasonable notice. Continued use of the Services after updated Terms take effect means you accept the updated Terms.
